any of its affiliates, operates or controls any information, products
or services on the Internet in that in any way, except for information
clearly identified as belonging to infopages.net, Inc., all services
or products, merchandise, information and services are generally offered
or made available or accessible on the Internet by third parties who
are not associated with infopages.net, Inc. or its affiliates.

sole risk and you agree that any information, service or
product provided generally on the Internet is without warranties

or implied, including but not limited to, warranties of title or implied
warranties of merchantability or fitness for a particular purpose,
other than those warranties which are implied by and incapable of
exclusion, restriction or modification under the laws applicable to
this agreement. You understand that portions of the
Internet contain materials that are unedited, sexually explicit
and may be offensive to you and that your access to such materials
is at your own risk. infopages.net, Inc. has no responsibility for
or control over such materials.
Under no circumstances, including negligence, shall infopages.net,
Inc., nor anyone else involved creating, producing, or distributing
the infopages.net, Inc. Services, nor infopages, Inc. software, be
liable for any direct, indirect, incidental, special or consequential
damages that may result from the use of or inability to use the infopages.net.
Inc. service or infopages.net, Inc. software including or resulting
from the following: mistakes, omissions, interruptions, deletions
of files or E-Mail, errors, defects, computer viruses, delays in operation
or transmission, or any failure of performance, communications failure,
theft, destruction or unauthorized access to infopages.net, Inc.'s
records, programs, or services whether due to inclement weather or
other acts of god. You hereby acknowledge that his paragraph shall
apply to all content, merchandise or services available through the
infopages.net, Inc. service. Because some states do not allow the
exclusion or limitation of liability for consequential or incidental
damages, in such states infopages.net, Inc.'s liability is limited
to the greatest extent permitted by law.
As a member you are responsible for all charges (e.g. telephone, etc.)
associated with connecting to the infopages.net, Inc. service through
an available access number. Member is responsible for obtaining or
providing all telephone access lines, telephone and computer equipment
(including modem) or other access device, necessary to access infopages.net,
Inc. services.
Member certifies to infopages.net, Inc. that he/she is not
a minor. A minor's parent or legal guardian may authorize
a minor to use his/her account under supervision. Member agrees
to provide infopages.net, Inc. with accurate, complete, and updated
information required by registration to the infopages.net, Inc. service.
This includes member's legal name, address, telephone number(s),
date of birth, driver's license data (e.g. driver's license number,
state of issue, and expiration date), applicable payment data. (e.g.
credit card type, number and expiration date). Members agree to notify
infopages.net, Inc. within 30 thirty days of any changes in registration
information. Failure to comply fully with this provision may result
in immediate suspension or termination of your right to use the infopages.net,
Inc. service.
Accounts • Charges • Payments
This agreement applies to all accounts, sub-accounts, and alternative
net names associated with member's principle account. Each member
is responsible for the use of his/her account(s) under any net name
associated with that account by any person, and for ensuring full
compliance with this agreement by all users of his/her account(s).
infopages.net, Inc. service account may not be transferred without
prior written permission from infopages.net, Inc., and is subject
to any present or future limits established by infopages.net, Inc.
Member is responsible for the maintaining the confidentiality
of his/her passwords. Member is responsible for any and all
activity and charges resulting from use of member's principle account
with infopages.net, Inc. services. Member agrees to pay all monthly
membership fees, connect time charges, surcharges, and other charges
incurred by member and/or his/her designated users. In the event of
a breach of security, such as that resulting from unauthorized use
of member's account, member will remain liable for any and all chargers
due to infopages.net, Inc. Service until member notifies infopages.net,
Inc. by phone at (904) 880-5521.
Current rates for use of infopages.net, Inc. facilities may be obtained
by calling (904) 880-5521 or e-mailing us at sales@infopages.net.
infopages.net, Inc. reserves the right to change fees, surcharges,
monthly membership fees, or to institute new fees at any time upon
(30) thirty days prior notice. In the event a member's account is
terminated or cancelled, on-line time credited to member's account
is not convertible to cash or other form of credit. If infopages.net,
Inc. does not receive full amount of member's account balance within
thirty days of invoice date, an additional monthly late charge of
1.5%, or highest amount permitted by law, will be added to member's
bill and shall be due and payable upon demand. Member shall also be
liable for all attorney and collection fees arising from infopages.net,
Inc.'s efforts to collect any unpaid balance of member's unpaid account(s).
Member may order and purchase merchandise or services from other members
and users of the Internet who are not affiliated with infopages.net,
Inc. All transactions concerning third party (Seller) merchandise
or services, including but not limited to purchase or payment terms,
warranties, guarantees, maintenance, and delivery, are solely between
Seller and member. infopages.net, Inc. makes no warranties or representations
whatsoever with regard to any goods or services provided by Seller.
infopages.net, Inc. shall not be a party to a transaction between
member and Seller, nor be liable for any cost or damage arising either
directly or indirectly from any action or inaction of Seller.
infopages.net, Inc. may elect to electronically monitor the infopages.net
service and may disclose any content or records to satisfy any law
enforcement agency, regulatory or other governmental request or to
properly operate the infopages.net, service and protect its members.
infopages.net, Inc. reserves the right at its sole discretion to review,
edit, or refuse to post any material or information. Notwithstanding
the foregoing infopages.net, Inc. will not intentionally disclose
any private e-mail message unless permitted or required by law. infopages.net,
Inc. reserves the right to remove any content that it deems in its
sole discretion to be unacceptable or undesirable. infopages.net may
also monitor at any time without notice any and all activities occurring
on any equipment it owns or operates for purposes of quality control.
Either member or infopages.net, Inc. may terminate membership at any
time. Member's only right with respect to any dissatisfaction with
any terms, rules, policies, guidelines, or practices of infopages.net,
Inc. regarding the operation or any change in the content of the infopages.net,
service, is to terminate membership by delivering notice to infopages.net,
Inc. Such termination will be effective the day infopages.net, Inc.
receives notification or on any future date specified which is acceptable
to infopages.net, Inc. infopages.net, Inc. may terminate without notice
member's access to and use of the infopages.net, service and infopages.net,
software upon a breach of this Agreement. If infopages.net, Inc. denies
access to the infopages.net, service, no rights will be granted: (a)
to obtain any credit(s) otherwise due and such credit(s) will be forfeited;
(b) to access through infopages.net, Inc. any materials stored on
the Internet or any third-party providers of services, merchandise
or information on the Internet through infopages.net, Inc. infopages.net,
Inc. shall have no responsibility for any damages that result from
the lack of such notification.
Upon request of infopages.net, Inc., member agrees to defend, indemnify
and hold harmless infopages.net Inc., its officers, directors, employees,
agents and licensees, from any claims and expenses, including reasonable
attorney's fees, in connection with your use of the infopages.net
service and the Internet.
"This Agreement shall be governed by the laws of the State of
Florida. This Agreement constitutes the entire agreement between you
and infopages.net Inc. with respect to the infopages.net service.
infopages.net Inc.'s failure to enforce any provision hereof shall
not be construed as a waiver of any provision or right. In the event
that a portion of this Agreement is held unenforceable, the unenforceable
portion shall be construed in accordance with applicable law as nearly
as possible to reflect the original intentions of the parties and
the remainder of the provisions shall remain in full force and effect."
Third party software available through the infopages.net Service may
be governed by separate end user licenses; member agrees to be bound
by the terms of such end user licenses regarding the applicable third
party software.
By purchase of service or merchandise from infopages.net, Inc. the
user agrees to all terms and conditions set forth within.
